Frente a la teoría de la pena, con sus sutiles matices y fines comunicativos, encontramos una realidad que diverge sustancialmente de aquella. Donde, con frecuencia, la denominada prevención general no acontece, porque la resolución no llega a esta, a la generalidad a la que se apela como fundamento del castigo. Pero, en particular, cuando tal comunicación acontece, tiene lugar en un inquietante marco discursivo que va dando nombre a nuestro tiempo: la era de la posverdad. Se revela aquí un contexto (...) comunicativo hostil al discurso experto y a los hechos, que se ven desplazados por su valoración, donde los interlocutores se alejan del modelo del ciudadano racional sobre el que se teoriza en Derecho, y donde actores políticos desarrollan estrategias comunicativas propagandistas, de modo que, en ocasiones, se termina comunicando un mensaje contrario a lo que enuncia literalmente la resolución judicial. RESUMEN: Este trabajo centra la atención en las características formales de la ley humana en el pensamiento de Juan de Mariana. En él se ofrece una presentación general de aquellas, acompañada de algunas circunstancias de la época. A continuación se trata de determinar la intención del autor en sus desarrollos y se analizan sus aportaciones, tanto desde la perspectiva del pensamiento ilustrado como desde el iusfilosófico de nuestro tiempo. Todo ello evidencia puntos de encuentro, pero también diferencias relevantes. El estudio (...) repara además en la aportación de los aspectos considerados en los ámbitos de la limitación al poder y la justicia. ABSTRACT: This article considers the formal characteristics of human law in the thought of Juan de Mariana. After a general introduction to those characteristics, accompanied by some contextual background, an attempt is made to ascertain the author’s intentions as his thought developed and to analyse his particular contribution to the matter through the double optic of enlightenment thought on the one hand, and contemporary jusphilosophy on the other. Some points of connection are found, but also various significant differences. At the same time, the article also gives some thought to the contribution made by the various aspects under consideration in the fields of justice and of the restriction of power. (shrink)

El presente trabajo explora la postura bergsoniana en torno a la imagen, toda vez que es constituida, de fondo, por la pregunta ¿qué se puede conocer? A propósito del tema Bergson se ubica en un punto intermedio entre el idealismo y el realismo, considera que la imagen es aquello que es más que una representación pero menos que la cosa en sí que el realismo pretende mostrar como objeto de conocimiento. La comprensión de la imagen no sólo lleva a escenarios (...) epistemológicos, también posibilita observar que ahí donde hay una perspectiva ocurre un enfoque interesado de cierto tema. De tal forma que la relación objeto-sujeto se ve trastocada por la implementación de la imagen, como disposición afectiva del mundo que rodea al humano. Si sólo se conocen imágenes, la pertinencia de las distintas ramas científicas cambia según estas estudien imágenes interiores o exteriores. Para nada la actividad mental, puede ser el propiciador de las imágenes mentales, únicamente es una imagen más del conjunto de imágenes. En lo subsecuente, habrá un desarrollo del conocimiento de las imágenes, una propuesta teórica que ofrece una posibilidad distinta a la científica, pero que no es contradictoria. The aim of this research was to explore the elements that configure the quality of care among three Mexican same-sex planned families: two female-parented families (through donor insemination) and a male-parented one (through adoption). The first family consisted of two mothers and a 3-year-old daughter; the second one had two mothers and a 1.5-year-old set of boy twins and the third family consisted of two fathers and a 2-year-old girl. It was assumed that Ainsworth’s notions of quality of care organization (...) are useful in order to understand caregiver-child attachment relationships, regardless of the parents’ sexual orientation. A collective case study was selected due to the fact that these families shared their “unconventionality” (i.e. parents were not heterosexual) and the fact that they were planned, but each one constituted a particular case with a unique configuration. Four trained independent observers used the q-sort methodology (Maternal Behavior Q-Sort and Attachment Q-Sort) to describe parents’ and children’s behavior, respectively. The findings showed that parents were highly sensitive and all children used them as a secure base. To provide an in-depth examination of which elements configure the quality of care, a semi-structured interview with each parent was carried out. Through a thematic analysis, an over-arching theme named Affections and Emotions was identified, together with six subthemes: 1) Creating an affective environment; 2) Being available; 3) Acknowledging and expressing emotions; 4) Perceiving, interpreting and responding adequately to the child’s real self; 5) Taking the child’s perspective into account; and 6) Agreeing on roles and dividing the tasks. In order to showcase the particular configuration of gay parenting, the male-headed family narrative is reported in detail, because gay parents have been perceived as violating traditional gender roles as well as the hegemonic model of masculinity. The findings were consistent with the notion of quality of care as proposed by Ainsworth and her collaborators. The implications of the methodological device and research regarding same-sex planned families are discussed so as to understand the organization of the caregiving environment. (shrink)

The primary objective of the research was to validate the Emotional Leadership Questionnaire for Training, as proposed by McKee et al. (2008). The study included a sample of 97 school principals. An analysis of the original questionnaire was conducted, which comprises four factors and 25 items. Of these, three items and 13 factors were retained. The results demonstrated an optimal fit of the model and high-reliability indices. This instrument provides a practical self-perception tool to assess emotional leadership, underscoring the importance (...) of empathy, adaptability, and self-knowledge in the training of school principals. The content validity was established through the assessment of 15 experts using Lawshe's formula, which demonstrated the validity of all items and dimensions. The reliability was evaluated through Cronbach's alpha and Omega indices, which yielded values between 0.77 and 0.86 and between 0.79 and 0.87, respectively. These results indicate high reliability for all factors. Construct validity was confirmed through confirmatory factor analysis. (shrink)

The opposition prose/verse can only be established in the heart of literal language. The only way of producing nonliteral language is in conversation. . . . Enrique Anderson Imbert published a book in 1958 titled ¿Qué es la prosa? , in which he says: 'No, we do not speak in prose. Prose is not a projection of everyday speech, but rather artistic elaboration."1 But my adherence to his intelligent point of view is not total because he situates prose in the (...) heart of written language, and I think that it should be ascribed to literal language. For Anderson Imbert such an idiomatic modality results in an artistic elaboration; but the intention of prose can be quite different. The reader, for instance, by virtue of his reading, can transform prose into literature; and unwritten prose does exist, as has been stated. In many cases it is impossible to compose the texts in verse; structurally, then, an opposition cannot be established, just as in the case of the student who takes notes following the explanations of the professor. This paper presents a study on how corporate social responsibility (CSR) strategies create value amongst family and non-family firms. Additionally, in our study, we considered the moderating effect of independent directors on the relationship between CSR and firm value. Based on data drawn from companies operating in 61 countries over an 11-year period (i.e. from 2010 to 2020), our findings demonstrate that non-family firms derive market benefits from the governance improvements made by independent directors concerning CSR strategies. In contrast, the (...) CSR strategies promoted within family firms are associated with lower firm value. However, this negative association is neutralised by the role played by independent directors, especially when the company is controlled by succeeding generations and not just by the founding one. These directors play a dissuasive role that leads family members to reassess their external socio-emotional preferences (reputation, image, etc.) in order to uphold the internal priorities of day-to-day decision-making. The literature on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises concerns that these technologies may affect personality, mood, and behavior. We conducted semi-structured interviews with researchers (n = 23) involved in developing next-generation DBS systems, exploring their perspectives on ethics and policy topics including whether DBS/aDBS can cause such changes. The majority of researchers reported being aware of personality, mood, or behavioral (PMB) changes in recipients of DBS/aDBS. Researchers offered varying estimates of the frequency of PMB changes. A (...) smaller majority reported changes in personality specifically. Some expressed reservations about the scientific status of the term ‘personality,’ while others used it freely. Most researchers discussed negative PMB changes, but a majority said that DBS/aDBS can also result in positive changes. Several researchers viewed positive PMB changes as part of the therapeutic goal in psychiatric applications of DBS/aDBS. Finally, several discussed potential causes of PMB changes other than the device itself. (shrink)

This article analyzes a panel of 550 international firms, for the period 2004 to 2010, to compare the role of female directors in family and non-family firms in promoting responsible practices. Many studies have associated the presence of women on the board with a higher degree of socially responsible commitment. However, we found that this is much less so in family firms than in non-family firms. In family firms, corporate social responsibility commitment does not vary significantly with the presence of (...) female directors, as the latter tend to behave in accordance with the family orientation toward CSR. This orientation depends on the stakeholders being addressed, with greater social responsibility shown toward external stakeholders than internal ones. (shrink)

The expansion of research on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises important neuroethics and policy questions related to data sharing. However, there has been little empirical research on the perspectives of experts developing these technologies. We conducted semi-structured, open-ended interviews with aDBS researchers regarding their data sharing practices and their perspectives on ethical and policy issues related to sharing. Researchers expressed support for and a commitment to sharing, with most saying that they were either sharing their data (...) or would share in the future and that doing so was important for advancing the field. However, those who are sharing reported a variety of sharing partners, suggesting heterogeneity in sharing practices and lack of the broad sharing that would reflect principles of open science. Researchers described several concerns and barriers related to sharing, including privacy and confidentiality, the usability of shared data by others, ownership and control of data (including potential commercialization), and limited resources for sharing. They also suggested potential solutions to these challenges, including additional safeguards to address privacy issues, standardization and transparency in analysis to address issues of data usability, professional norms and heightened cooperation to address issues of ownership and control, and streamlining of data transmission to address resource limitations. Researchers also offered a range of views on the sensitivity of neural activity data (NAD) and data related to mental health in the context of sharing. These findings are an important input to deliberations by researchers, policymakers, neuroethicists, and other stakeholders as they navigate ethics and policy questions related to aDBS research. L’article explore le statut du trans en partant de l’hypothèse qu’il incarne mieux que quiconque l’archétype de l’ex en tous genres : pour les trans plus que pour tout autre, la rupture est une dimension constitutive de l’existence. La présente contribution se fonde sur une recherche sur la construction identitaire chez les trans, recherche menée auprès de six personnes à partir d’entretiens semi--directifs, d’observation et d’entretiens téléphoniques. Il fait référence aux « grandeurs » de Boltanski et Thévenot (1991). En este trabajo se aborda el tema del lenguaje de la ley humana en el pensamiento de Francisco Suárez. El desarrollo se lleva a cabo teniendo en cuenta principalmente el Tratado de las leyes y de Dios legislador y comprende los siguientes aspectos: el carácter preceptivo del lenguaje legislativo, la forma escrita y oral, el nivel léxico-semántico y la claridad lingüística desde las perspectivas de la conveniencia, la esencia de la ley y la justicia. Las cuestiones tratadas por Suárez a (...) propósito de estos aspectos han seguido siendo objeto de atención en épocas posteriores y en nuestros días. Hoy la lectura de algunas de ellas infunde la idea de que siguen vigentes. Por todo ello, junto a la exposición de contenidos, que pretende describir y ofrecer pautas para entender las ideas del jesuita, se presentan otros análisis de carácter comparativo y reflexivo; aunque sin perder de vista que nos centramos en un autor que escribió en la Edad Moderna. El objetivo del presente artículo será realizar una revisión crítica de la interpretación realizada por D. Harvey del concepto de «acumulación originaria» expuesto por K. Marx en El Capital. A través del análisis de los escritos dónde Marx aborda esta cuestión, trataremos de demostrar que la aportación principal de Harvey -reinterpretar la acumulación originaria, no como proceso fundacional de las condiciones necesarias para la producción capitalista, sino como proceso continuo y permanente utilizado para restablecer las condiciones óptimas de la acumulación (...) de capital mediante la conquista de nuevos espacios- se sustenta en una interpretación parcial de los textos de crítica de la economía política marxianos que confunde la dimensión lógica e histórica del análisis marxiano. Así pues, argumentaremos que existe una base en los propios textos de Marx desde dónde interpretar la «acumulación originaria» como un proceso de desposesión constante en el desarrollo del modo de producción capitalista que, dependiente de la constante expansión, potencia su capacidad adaptativa mediante la conquista de aquellos factores de la economía todavía no incorporados al proceso del capital. This study analyses the contents of two Egerton manuscripts. These manuscripts are part of the correspondence of 1598 between Mariana and García de Loaysa. This study interprets the texts of these documents as recording some of the Jesuit’s recommendations concerning the episcopal governance of his friend. Together, the texts offer several points of resemblance with Mariana’s ideas about civil government. They also reveal various intellectual concerns and the depth of his personal relations.

The contents of two Egerton manuscripts are analyzed in this paper. One, dating from 1598, is part of the correspondence between Mariana and García de Loaysa. In it, Mariana recommends someone for his friend’s government, refers to some issues of ecclesiastical policy, to his future publications and also expresses his gratitude for a personal favour. The second manuscript, dating from 1599, contains an epitaph written by Mariana after the death of García de Loaysa, which includes biographical details and feelings of (...) a family and personal nature. It amounts to a portrait which is strikingly different from other far more negative ones that history has bequeathed us. (shrink)

The preparation of teachers is a key process in the development of effective teachers, however, initial training always seems insufficient and outdated to produce the expected teaching profile and respond to the dynamic character of today's society. This article reports part of the research "teachers in the process of initial training" (2020-2021), developed in the context of a Faculty of Education Sciences, Chile. Based on a qualitative methodology and a case study research strategy, we worked with 120 pedagogy students in (...) the process of training, who offered their representations regarding the theory-practice relationship in the context of the Chilean educational system. In a complementary way, 5 focus groups were administered with the intention of enriching ideas and perspectives. The criteria to choose them were to be studying a pedagogy program, with experience of practices in schools and that they accepted to participate voluntarily, after signing consent. The results show that the theory-practice relationship can be understood in various ways: dependence, disagreement and integration which influence the way teaching is understood and its exercise. In terms of projections, the need arises to think of a training that in a bidirectional way manages to theorize the practice and experience the theory. (shrink)

The purpose of this study is to examine how workgroup diversity can be managed through specific strategic human resource management systems. Our review shows that ‘affirmative action’ and traditional ‘diversity management’ approaches have failed to simultaneously achieve business and social justice outcomes of diversity. As previous literature has shown, the benefits of diversity cannot be achieved with isolated interventions. To the contrary, a complete organizational culture change is required, in order to promote appreciation of individual differences. The paper contributes to (...) this discussion by exploring the implications of this change for human resource management, and explaining how the systems of practices should be changed when they are directed to diverse groups. The model designed to test this notion includes: (1) demographic and human capital diversity as independent variables, (2) group performance (measured as innovation outcomes) as the dependent variable and, (3) the orientation of the strategic human resource management system as a potential moderator of this relationship. The main conclusion of the empirical analysis developed is that different patterns of human resource management practices can be used, depending on the type of diversity that the organization faces, and the specific effects that it wishes to manage. Concretely, three alternative management systems are identified in this paper, with different moderating effects. This result has interesting implications for human resource management professionals, explained in the last section. The limitations of this study are also discussed, as well as some issues that future research in this field should address. (shrink)

El presente ensayo se propone examinar cómo los individuos en contextos de confinamiento carcelario - quienes han contribuido activamente en el desarrollo de esta investigación - pueden no solo experimentar la libertad de manera gradual, sino también producir libertad creadora a través de un proceso dialéctico en relación con su pasado, presente y futuro; y cómo este último –al que le daremos una mayor preponderancia– tiene como elemento inherente el potencial de transformar ontológicamente su existencia. Para ello, nos basamos en (...) tres tesis fundamentales: la idea de "libertad" en Jean-Paul Sartre, el "hombre histórico" en Friedrich Nietzsche y el concepto de "ser de lejanías" de Vicente Fatone. La imbricación de estas perspectivas permite comprender cómo una persona en un entorno de confinamiento puede desarrollar una libertad ontológica que trasciende las limitaciones ónticas y deterministas de su situación, modificando su ser y proyectándose hacia un futuro distinto. The capacity of next-generation closed-loop or adaptive deep brain stimulation devices to read and write shows great potential to effectively manage movement, seizure, and psychiatric disorders, and also raises the possibility of using aDBS to electively modulate mood, cognition, and prosociality. What separates aDBS from most neurotechnologies currently used for enhancement is that aDBS remains an invasive, surgically-implanted technology with a risk-benefit ratio significantly different when applied to diseased versus non-diseased individuals. Despite a large discourse about the ethics of enhancement, (...) no empirical studies yet examine perspectives on enhancement from within the aDBS research community. We interviewed 23 aDBS researchers about their attitudes toward expanding aDBS use for enhancement. A thematic content analysis revealed that researchers share ethical concerns related to safety and security; enhancement as unnecessary, unnatural or aberrant; and fairness, equality, and distributive justice. Most researchers felt that enhancement applications for DBS will eventually be technically feasible and that attempts to develop such applications for DBS are already happening. However, researchers unanimously felt that DBS ideally should not be considered for enhancement until researchers better understand brain target localization and functioning. While many researchers acknowledged controversies highlighted by scholars and ethicists, such as potential impacts on personhood, authenticity, autonomy and privacy, their ethical concerns reflect considerations of both gravity and perceived near-term likelihood. We used 7,415 advertisements published in Spain to analyze traits sought/offered by men and women from different age groups. Findings regarding age, socioeconomic status, and physical attractiveness requirements support evolutionary predictions about mate preferences. However, changes in trait preferences among women under 40 appear to be contingent on Spain’s socioeconomic transformation. Women under 40 seek mainly physical attractiveness in men, whereas those over 40 seek mainly socioeconomic status. The trait most sought by men in all age groups is physical attractiveness. (...) Traits sought and offered by advertisers may be conditioned by the personal situation of the advertiser. Mean age of advertisers (around their forties) and Spain’s social indicators suggest that the majority of advertisers have been unsuccessful in the mating arena at the conventional age. (shrink)
